In these Terms and Conditions, “Racehorse Rescue Centre”, “the charity”, “we”, “us” and “our” refer to Racehorse Rescue Centre.

2. About these terms

These Terms and Conditions govern:

  • your use of this website;
  • purchases made through our charity shop;
  • donations, sponsorships and symbolic gifts;
  • memberships and recurring support arrangements; and
  • your use of information, forms and links appearing on the website.

By using this website, you agree to these Terms and Conditions. Please stop using the website if you do not agree with them.

Certain activities may also have separate terms, including our charity lottery, horse rehoming arrangements, volunteering, work placements, courses, events and services delivered by external providers. Where separate terms apply, those terms will take priority for that particular activity.

3. Using our website

You may use this website only for lawful purposes.

You must not:

  • attempt to gain unauthorised access to the website, its server or connected systems;
  • introduce viruses, malicious software or other harmful material;
  • use the website in a way that interferes with its operation or another person’s use;
  • use our content for misleading, fraudulent or unlawful purposes; or
  • copy or commercially exploit our content without permission.

We may suspend or restrict access to all or part of the website where reasonably necessary for security, maintenance, misuse or operational reasons.

4. Website information

We take reasonable care to keep the information on this website accurate and current. However, some information may change, including information about horses, products, programmes, events, availability and third-party services.

Information about horses, horse care, veterinary matters, health, wellbeing, education or therapeutic activities is provided for general information only. It is not a substitute for advice from a veterinary surgeon, doctor, therapist, solicitor or other appropriately qualified professional.

We do not guarantee that the website will always be available, uninterrupted or free from errors.

5. Website accounts

Where you create an account, you must provide accurate information and keep your login details confidential.

You are responsible for activity carried out through your account unless you have told us that your account may have been accessed without permission.

We may suspend or close an account that is being misused or used unlawfully.

6. Donations

Donations to Racehorse Rescue Centre are voluntary gifts that support our charitable work.

Unless a particular appeal states otherwise, unrestricted donations may be used by the trustees where they consider the need to be greatest and in furtherance of the charity’s objects.

Where a donation is made to a particular appeal, horse or project, we will use reasonable efforts to apply it for that purpose. If the purpose has been fully funded, becomes impractical or can no longer proceed, the trustees may apply the donation to a similar charitable purpose where legally permitted.

Donations are generally non-refundable. We may consider a refund where:

  • a donation was made in error;
  • the same donation was processed more than once;
  • the payment was unauthorised or fraudulent;
  • the donor was not able to make an informed decision; or
  • a refund is required by law.

Any refund will be considered in accordance with charity law, the charity’s policies and, where necessary, trustee approval. Please contact us promptly if you believe that a payment has been made incorrectly.

Payments may be processed by an external payment provider. That provider’s own terms and privacy notice may also apply.

7. Gift Aid

You are responsible for making sure that any Gift Aid declaration you provide is accurate and that you meet the applicable UK taxpayer requirements.

Please notify us if your circumstances change and your donations are no longer eligible for Gift Aid.

8. Charity shop orders

Products displayed in our charity shop are subject to availability.

Product descriptions, photographs and measurements are provided to help you make a purchasing decision. Colours and appearance may vary slightly depending on your device or screen.

Placing an order constitutes an offer to purchase the goods. Your order is accepted when we confirm that it has been accepted or dispatch the goods.

We may cancel an order before dispatch where:

  • an item is unavailable;
  • there has been an obvious pricing or description error;
  • payment has not been authorised;
  • we are unable to deliver to the address provided; or
  • we reasonably suspect fraud or misuse.

If we cancel an order after taking payment, we will refund the relevant amount.

All prices are shown in pounds sterling. Delivery charges, where applicable, will be displayed before the order is completed.

9. Symbolic gifts for horses

Some charity shop options, including gifts towards hay, feed, wormers, veterinary care or other horse-related costs, are donations rather than purchases of physical goods.

Where the product description states that no item will be sent to you, your payment is treated as a donation towards the charity’s work and no physical product will be supplied.

10. Delivery

We will deliver physical goods to the address entered during checkout.

Any delivery date is an estimate unless we have expressly agreed that a particular date is essential. Unless a different period has been agreed, we will aim to deliver the goods within 30 days of accepting the order.

Please check that the delivery address is complete and accurate. We are not responsible for delays or failed delivery caused by incorrect information supplied by the customer.

Responsibility for the goods passes to you when they are delivered to you or to a person identified by you to receive them.

11. Cancelling an online order

For most physical goods purchased online, you have the right to cancel your order without giving a reason.

The cancellation period ends 14 days after the day on which you, or a person nominated by you, receives the goods.

To cancel, you must clearly tell us of your decision before the cancellation period expires. You may contact us by email, telephone, post or by using the cancellation form at the end of these terms.

After telling us that you wish to cancel, you must return the goods within 14 days.

Unless the goods are faulty, damaged, incorrectly described or supplied in error, you are responsible for the direct cost of returning them.

You must take reasonable care of the goods. We may reduce a refund to reflect any loss in value caused by handling beyond what would reasonably be necessary to examine the goods.

12. Refunds following cancellation

Where you correctly cancel an order, we will refund:

  • the price paid for the returned goods; and
  • the cost of our least expensive standard delivery option, where a delivery charge was paid.

We are not required to refund any additional amount paid for premium, express or other enhanced delivery.

We will normally make the refund within 14 days of:

  • receiving the returned goods; or
  • receiving satisfactory evidence that the goods have been returned,

whichever occurs first.

Refunds will usually be made using the original payment method.

13. Exceptions to cancellation rights

The right to cancel may not apply to certain goods, including:

  • goods made to your specification or clearly personalised;
  • goods that deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for health or hygiene reasons once unsealed;
  • digital content where supply has begun after the required consent has been given; and
  • other goods or services excluded by law.

This does not affect your rights where an item is faulty, damaged, incorrectly described or not fit for purpose.

14. Faulty or incorrectly supplied goods

Goods must be as described, of satisfactory quality and fit for any purpose made known to us.

Please contact us promptly if an item is faulty, damaged, incorrectly described or not the item ordered. We will explain how to return it and, where appropriate, provide a refund, replacement or other remedy.

Nothing in these Terms and Conditions limits your statutory consumer rights.

15. Memberships and recurring support

Membership and recurring support arrangements begin once payment has been accepted.

The price, payment frequency and benefits will be those displayed when you join. Where you select automatic renewal, payments will continue at the stated interval until cancelled.

You may cancel a paid membership within 14 days of joining or renewing, subject to applicable consumer law. If benefits or services have already been provided at your request, we may make a lawful deduction reflecting what has been supplied.

After the initial cancellation period, you may cancel future automatic renewals through your account, the payment provider or by contacting us. Cancellation stops future payments but does not normally create a refund for a membership period that has already begun, unless required by law.

We may make reasonable changes to membership benefits or prices. We will give appropriate notice before a price change applies to a future renewal.

16. Horse sponsorship

Sponsorship supports the charity’s care of its horses. It does not give the sponsor:

  • ownership of a horse;
  • exclusive rights relating to a horse;
  • a guaranteed right to ride, handle or visit a horse; or
  • authority to make decisions about the horse’s care, training or future.

Unless expressly stated otherwise, sponsorship funds may be used for the general care and welfare of horses at the Centre.

The circumstances of an individual horse may change. A sponsored horse may be temporarily unavailable, moved, retired, rehomed or, sadly, may die. Where appropriate, we may offer to transfer the sponsorship to another horse or another area of our work.

Any visits remain subject to appointment, availability, risk assessment and the Centre’s safety and safeguarding requirements.

17. Charity lottery

Participation in our charity lottery is governed by the separate terms supplied by the independent lottery provider.

Those terms cover eligibility, payment, entry, draws, prizes, cancellations and complaints and take priority over these website Terms and Conditions for lottery participation.

Participants must be at least 18 years old and meet any residency or eligibility requirements stated by the lottery provider.

18. Affiliate and third-party offers

Some pages may contain advertising or affiliate links to third-party products and services, including insurance or retail products.

Racehorse Rescue Centre may receive a payment or commission when someone follows an affiliate link and completes a qualifying purchase or application. This normally does not increase the price paid by the customer.

Any contract for a third-party product or service is between you and the external provider. The provider’s own eligibility rules, prices, terms, exclusions, privacy notice, cancellation arrangements and complaints procedure will apply.

We do not control and are not responsible for the performance of products or services supplied by third parties.

19. Horse rehoming

Completing an enquiry form or expressing interest in a horse does not guarantee that a horse will be offered or rehomed to you.

All potential homes, riders and arrangements are subject to the charity’s assessment process, home checks and welfare considerations.

Any rehoming is governed by a separate written agreement. Ownership or title to a Racehorse Rescue Centre horse remains with the charity where this is stated in the rehoming agreement.

The welfare of the horse will remain the charity’s primary consideration.

20. Volunteering, placements, visits and programmes

Submitting a volunteer, placement, course, referral or visit enquiry does not automatically create a place, booking or contract.

Participation may be subject to:

  • availability;
  • suitability assessment;
  • safeguarding checks;
  • references or DBS checks where appropriate;
  • risk assessments;
  • induction and training;
  • supervision requirements; and
  • compliance with Centre rules and policies.

Visitors and participants must follow reasonable instructions given by authorised representatives of the charity.

21. Intellectual property

Unless stated otherwise, the website’s text, photographs, videos, graphics, branding, logos and other original content belong to Racehorse Rescue Centre or are used with permission.

You may view and print pages for personal and non-commercial use.

You must not reproduce, alter, sell, publish, distribute or commercially exploit our content without prior written permission.

Nothing on the website gives permission to use the charity’s name, logo or branding in a way that suggests endorsement, partnership or approval.

22. Links to other websites

This website may contain links to websites operated by other organisations.

Links are supplied for information or convenience and do not necessarily mean that we endorse everything on the external website.

We are not responsible for the content, security, availability or privacy practices of third-party websites.

23. Our liability

Nothing in these Terms and Conditions excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot legally be excluded.

Subject to the above, we are not responsible for losses caused by circumstances outside our reasonable control or for indirect or unforeseeable losses arising solely from use of the website.

The website is primarily intended for private and charitable use. We are not responsible for business losses, loss of profit or loss of commercial opportunity arising from use of the website.

We process personal information in accordance with our Privacy Policy.

Information about cookies and similar technologies is contained in our Cookies Policy.

25. Changes to these terms

We may update these Terms and Conditions to reflect changes in our website, services, payment arrangements, activities or legal obligations.

The date at the top of the page will show when the terms were last updated.

Changes will apply from the date they are published and will not remove rights that have already arisen under an existing contract.

27. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

The courts of England and Wales will generally have jurisdiction. Consumers living elsewhere in the United Kingdom retain any mandatory rights to bring proceedings in their local courts.

Cancellation form

Complete and return this form only if you wish to cancel a contract for physical goods or another purchase to which a legal cancellation right applies.
